Illinois Smoking Ban Takes Effect on New Years Eve

No smoking after midnight as Illnois' new smoking ban begins

Chicago, IL — At one minute past midnight tonight, smokers in Illinois will no longer be able to light up in their favorite establishments - including bars.

Illinois passed a no-smoking law this year that goes into effect at 12:01 a.m. Tuesday.  Smoking will be banned in most public places including restaurants, bars, bowling alleys and casinos.  Smokers will be required to smoke go outside at a distance of at least 15 feet from entrances, windows or exits at bar and restaurants to light up.

Businesses will also be required to post "No Smoking" signs, remove ashtrays and report customers who refuse to comply with the ban to police as of 12:01 a.m. Tuesday.

"This is a new day in Chicago and I'm happy about it," Chicago's Health Czar Terry Mason told Fox Chicago.

The CDC estimates 3,400 non-smokers lose their lives to lung cancer every year. Another 69,000 die from heart disease. Based on the experience in 22 other states, the ban is expected to result in about 300,000 Illinois smokers quitting the practice.

Business owners will be responsible for enforcement of the no-smoking ordinance and patrons can report businesses not complying with the new ordinance by calling 3-1-1.  Restaurant and bar owners will be fined only after two warning letters have been mailed post complaints and after a third complaint warrants a visit by an inspector.  Upon the third warning, business owners could face fines from $250 to $2,500 per violation.

Some bar owners are concerned that since the ban is to be implemented from midnight on Monday, New Year revelers may not take the sudden change too kindly and implementing the ban may be practically impossible at that time. 

Minibar | Winebar and Big Chicks are among several gay bars in Chicago that have offered a smoke-free environment for over a year.

Illinois is the 23rd state to pass a broad ban on indoor smoking.

I can see avoiding non-smokers and minors, and areas prone to fire. Health issues are are non-issues, cigarettes may be a factor but do not cause (and sometimes prevents) illness other than allergic reactions (most of which are psychosomatic). Consenting adults should be able to smoke in places where property owners allow it in a safe fashion.

That this law was passed for the nasty habit of others... I was tired of taking my kids into establishments, wether it was a returaunt or store and walking through a wall of smoke to get to the door. Its about time your nasty habit doesnt affect my children anymore.

I hate the smoke. Besides- 90 days from now, no one will think twice about the ban. Smokers may say they will stay home, but this comes from a group of people, who aren't exactly strong willed. No longer will my clothes stink up my house after bar close... because of YOUR habit.

Its ok to ban from restaurants, but bars come on people. It should be up to the owner if he wants a smoking or non smoking bar. If you don't like the smoke go to a different bar. Its like if we had a dictator, what happen to our rights.

Alcohol should be banned too, it's far more dangerous and deadly to the young then tabacco. America, home of the free? I can understand restaurants, but bars? Why can't I relax with a cigarette in public and act sane, but the yahoo next to me can relax with drinks and act insane and then drive away!

I am a non-smoker and I don't like the way my clothes smell after going to a bar. But at the same time I think that we are getting a little crazy with laws that take away personal freedoms. If you want to smoke then smoke. If I don't want to smell like smoke or be around smoke then I don't go someplace where people are smoking. I think that passing a law that tells people that they can't smoke is taking it a bit too far. And that people can't smoke so you don't have to worry about sheilding your ugly kid from it? I guess you shouldn't be taking your kids to the bar...(as a school teacher I know that there are parents that bring their kids to the bars with them)

Unfortunately the "land of the free" is faster then ever changing for the worse!! I can't wait to see what happens when the government tells restaurants that they have to test there patrons weight, fat, etc... in order to give them bacon because bacon is full of grease and fat and that is unhealthy to americans also!!!! I can't wait until something that stupid happens to non smokers and they start whining!! I will definitely vote for it because just like smoking it is bad for you and effects everyone around you (fat people take up to much space on planes, stink after a short period of time, etc...)!!

The 'No Smoking Law' in itself is illegal. And in a BAR is preposterous! The people who make these laws should be put in orbit. This way they would be closer to God and away from me.

This ought to be left to the owners. If an owner wants to be non-smoking more power to them, let his customers pass the word it is smoke free. This is personal freedom that is being taken away. Thank God I live close enough to MO to drive a couple of min to a bar that I can smoke in. I have frequented a local neighborhood tavern for years and now only for a drink or two a night now. They will be closed soon because of this, it isn't fair, local neighborhood places are getting killed by this.

How many non smokers here were raised by alcoholics? I have many non smoking friends that have drank themselves to death. was at a funeral 3 weeks ago. I have a big problem with people who complain about smoke filled bars telling me that I am ignorant of my health. Put the beer down and go home to your kids. If you hurry you might catch one of them smoking over a playboy.
