Chicago, IL — The U.S. Court of Appeals for the 7th Circuit reversed two lower court rulings that banned an Illinois high school student from wearing an anti-gay T-shirt to school. 

The court decided that Neuqua Valley sophomore Alexander Nuxoll was free to wear his "Be Happy, Not Gay" T-shirt to the Naperville high school the Chicago Tribune reported. 

Nuxoll and another student, Heidi Zamecnik, filed suit in March of last year charging Indian Prairie Unit District 204 violated their right to free speech by prohibiting them from wearing anti-gay T-shirts to school on the Day of Silence in 2006. 

The National Day of Silence has taken place in schools and colleges across the United States since 1996 to call for more tolerance for gay people.

Nuxoll and Zamecnik said they believed homosexuality was immoral.

The court's ruling comes two days before the annual Day of Silence this Friday.
